Terms & Conditions – Alison Jenkins Photography Training
Entire Agreement
These Terms and Conditions constitute the entire agreement between Alison Jenkins Photography (“the Trainer”) and the Client/Trainee. No variation shall be effective unless agreed in writing (including email) by both parties.
Booking Fee and Payment

A booking fee of 50% of the total tuition cost, together with a completed booking form, secures the Trainer’s time and services.

This fee is non‑refundable, as it covers administrative costs and loss of opportunity.

The remaining balance is payable two weeks before the agreed training date.

Cancellations made with less than 24 hours’ notice will not be eligible for a refund.

If the Trainer cancels, the Client will be offered either a full refund or an alternative date.
Travel
-
Travel within 15 miles of SG12 is included at no extra cost.

Travel beyond this distance will be charged at 45p per mile, including the return journey.

Additional expenses (e.g. parking, tolls, accommodation if required) will be agreed in advance with the Client.
Weather and Delays

Training will proceed as scheduled, weather permitting.

In the event of inclement weather, the Trainer will work with the Client to rearrange the session at a mutually convenient date.

No additional fee will be charged for rescheduling due to weather.
Force Majeure

The Trainer shall not be liable for failure to perform obligations where such failure is due to causes beyond reasonable control (including illness, injury, crime, flooding, or other unforeseen events).

In such circumstances, liability is limited to a refund of all monies paid.

Nothing in this agreement limits liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded under UK law.
Copyright
-
Clients/Trainees retain copyright in their own images taken during the workshop.

All teaching materials, demonstration images, and other creative works produced by Alison Jenkins Photography remain the property of the Trainer and are protected under the Copyright, Designs & Patents Act 1988.

No image, file, or program belonging to the Trainer may be copied, reproduced, or distributed without prior written permission.

Trainees may use their own images for personal or commercial purposes, but must not misrepresent them as the Trainer’s work.
Data Protection & Privacy

Personal information provided by the Client will be handled in accordance with UK GDPR and the Data Protection Act 2018.

Data will only be used for the purposes of administering training sessions and will not be shared with third parties without consent.
Complaints Procedure

Any concerns should be raised with the Trainer as soon as possible.

The Trainer will make every effort to resolve complaints promptly and fairly.
-
If unresolved, disputes may be referred to mediation before court proceedings.
Limitation of Liability

Except as stated above, the Trainer’s liability is limited to the total value of the contract.

The Trainer is not liable for indirect or consequential losses (e.g. loss of profit, data, or opportunity).
Severability
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Governing Law
This agreement shall be governed by and construed in accordance with the laws of England and Wales. The parties submit to the exclusive jurisdiction of the courts of England and Wales.
